Steven A. Hann

Steven Hann is a Partner at the Pennsylvania law firm of Hamburg, Rubin, Mullin, Maxwell & Lupin, where he focuses his practice on environmental and municipal law and chairs the firm's Environmental Law Department. Steve personally deals with and is experienced in every facet of an environmental law practice. Steve represents a diverse client base, including municipalities, municipal authorities, business entities, individuals, builders and developers, all of whom are affected by the complex web of federal and state environmental laws and regulations. Steve handles all aspects of environmental litigation with government agencies and private parties. Steve also advises clients on regulatory and compliance issues, environmental permitting, environmental issues arising in business and real estate transactions, the land development process, and land use and zoning issues. Steve also provides clients with experienced counseling on environmental legislative and regulatory developments at the federal and state levels. As a complement to his environmental law practice, Steve has developed a secondary practice in the area of municipal law, where he represents and advises municipalities and municipal authorities on a wide array of issues unique to these entities.

Prior to law school, Steve was an environmental consultant. Following his graduation from Penn State, Steve was employed as a meteorologist focusing on air quality and air pollution issues. Thereafter, Steve was hired as a member of the United States Environmental Protection Agency's (EPA) Field Investigation Team under the federal Superfund program, where he was engaged in various activities related to the investigation and remediation of hazardous waste sites. In the latter position, Steve was selected by EPA Headquarters to travel throughout the country as a speaker for an EPA hazardous waste site inspection training course.

Practice Areas:

Environmental Litigation
* Steve represents clients in all aspects of environmental litigation at the federal and state court levels and before administrative hearing boards. He also represents clients in various environmental and land use/zoning matters before local government bodies.
* Environmental litigation matters handled by Steve include government enforcement proceedings; permit appeals; challenges to established TMDLs; soil and groundwater contamination suits; appeals of municipal wasteload management and sewage facilities planning decisions; land use and zoning disputes; toxic tort claims; resolution of cost allocation issues; storage tank actions; and the prosecution and defense of private party actions under various environmental laws.
* Steve represented the prevailing party in a landmark case decided by the Pennsylvania Supreme Court in which the Court held for the first time that a private cause of action existed under the Pennsylvania Storage Tank and Spill Prevention Act. Centolanza v. Lehigh Valley Dairies, Inc., 658 A.2d 336 (Pa. 1995).
* Steve is counsel to a number of municipal entities in appeals of TMDLs, including the first two major state appeals of a TMDL in Pennsylvania, Lower Salford Township Authority, et al v. Commonwealth of Pennsylvania, Department of Environmental Protection, EHB Docket No. 2008-238-K, Lower Salford Township Authority and Upper Gwynedd-Towamencin Municipal Authority v. Commonwealth of Pennsylvania, Department of Environmental Protection, EHB Docket No. 2005-100-K; and Hatfield Township Municipal Authority, et al v. Commonwealth of Pennsylvania, Department of Environmental Protection, EHB Docket No. 2004-046-L. Significantly, the TMDLs that were subject of the latter two appeals were withdrawn by the government prior to being implemented and prior to being incorporated into the NPDES permits of those wastewater treatment plants in the respective watersheds.
* Steve is co-counsel to nearly eighty municipalities/municipal authorities in a challenge involving Pennsylvania's Chesapeake Bay Tributary Strategy. In this case, Steve successfully argued against a DEP motion to dismiss the municipal entities challenge before an en banc panel of the Commonwealth Court. Borough of Bedford, et al v. Commonwealth of Pennsylvania, Department of Environmental Protection; Kathleen McGinty, Secretary of Environmental Protection, 972 A.2d 53 (Pa.Cmwlth.2009)
* Steve obtained a significant penalty reduction for a client in a federal administration action before the federal Environmental Appeals Board ("EAB") under the Resource Conservation and Recovery Act. In the Matter of Rybond, Inc., Docket No. RCRA-III-247.
* Steve represented a local water authority in a private cost recovery action brought in federal court pursuant to various environmental laws. North Penn Water Authority v. BAE Systems, et al, (E.D.Pa.) 2005 WL 2304736, 2005 WL 1715718, and 2005 WL 1279091.
* Steve represented a local municipality in underlying zoning litigation involving the expansion of a landfill and a constitutional challenge to the municipality's zoning ordinance. Steve prevailed at the local govenment level, which decision was eventually affirned by the Pennsylvania appellate courts. SECCRA v. Zoning Hearing Board of London Grove Township, et al, 898 A.2d 680 (Pa. Cmwlth 2006), allocatur denied, 591 Pa. 740, 921 A.2d 499 (Pa.2007).
* Steve has represented various clients in over 25 appeals to Pennsylvania's Environmental Hearing Board on a broad range of issues ranging from air and NPDES permitting to sewage facilities planning and municipal wasteload management.

Regulatory Compliance
*  Steve provides a wide range of counseling on current and emerging federal and state regulatory and compliance issues related to air and water quality/pollution control, land use, solid and hazardous waste management and occupational safety and health.
*  Steve advises clients on a broad array of environmental permitting issues (air, NPDES, pretreatment, stormwater, wetlands, landfill, radiation protection, solid and hazardous waste), government reporting obligations, waste disposal and site remediation requirements and the regulatory process under federal and state voluntary cleanup programs.
*  Steve provides guidance on numerous land use-related issues involving water and sewer service; municipal wasteload management; sewage facilities planning and regulation; stormwater management; wetlands and natural resources; and erosion and sediment control.

 

Transactional Matters
*  Steve counsels clients on environmental matters in real estate and business transactions, including the evaluation of lender requirements, the economic aspects of such transactions and the identification and management of environmental risk.  He also guides clients through the complex regulatory maze for both property development and the redevelopment of environmentally impaired and Brownfields properties.  
*  Steve prepares environmental provisions for transactional documents and negotiates prospective purchaser and buyer-seller agreements with federal and state government agencies.
*  Steve is experienced in assisting clients in addressing environmental due diligence, land use and zoning issues, and works closely with environmental consultants on the review and assessment of technical documents.

Municipal Environmental Issues
* Steve has developed a specific expertise in environmental matters affecting municipal authorities and municipalities. He represents these entities in environmental litigation matters and routinely advises them on the numerous environmental regulations and policies unique to them.
* Steve is experienced in issues involving water and sewer service; NPDES permitting and enforcement; wasteload allocation; pretreatment; TMDLs; municipal wasteload management; sewage facilities planning and regulation; wet weather issues (including SSO's and CSO's); stormwater requirements; wellhead protection; and the public water supply.
* Steve has drafted and amended various ordinances for use by municipal entities in the areas of municipal authority enforcement, pretreatment and waste disposal.  He also routinely advises municipal entities on emerging environmental and land use legislative and regulatory developments at the federal, state and local levels, and prepares written comments on behalf of such entities on government regulatory and policy initiatives. Most recently, Steve submitted comments on several Pennsylvania Department of Environmental Protection regulatory initiatives, including proposals addressing NPDES permits, wastewater treatment requirements and Chesapeake Bay Water Quality Standards Implementation. In addition, he submitted comments to the United States Environmental Protection Agency on initiatives dealing with stormwater and the development of TMDLs. He also submitted comments to the United States Environmental Protection Agency on its draft strategy for protecting and restoring the Chesapeake Bay. Finally, he also provided written and oral comments in connection with the United States Environmental Protection Agency Science Advisory Board’s peer review of EPA’s draft guidance document entitled Empirical Approaches for Nutrient Criteria Derivation.
* Steve is co-counsel to numerous municipal entities on issues arising from the development of the Chesapeake Bay TMDL, the most complex TMDL ever contemplated in the United States.
* Steve is the Pennsylvania Bar Association's representative to Pennsylvania's Sewage Advisory Committee.
* Steve was appointed by the Pennsylvania General Assembly to serve on an advisory committee to a legislative task force on sewage management and treatment established pursuant to House Resolution 88 of 2005, and has testified before the task force on the impact of TMDLs on municipal authorities and impending statewide nutrient water quality criteria.
* Steve served as a member of the Point Source Workgroup established by the Pennsylvania Department of Environmental Protection, which was designed to address point source issues related to Pennsylvania's Chesapeake Bay Tributary Strategy.
* Steve was a member of the Legislative and Regulatory Needs Work Group established in 2008 under Governor Rendell's Sustainable Water Infrastructure Task Force.
* Steve is a frequent speaker on issues related to municipal entities and has presented two national teleconferences that he developed on water quality issues affecting wastewater treatment plants.

Municipal Law Issues
*  Steve routinely handles a wide range of issues unique to municipal authorities under the Municipality Authorities Act, and works closely with municipal authority engineers and staff on a variety of matters.
*  Steve handles telephone inquiries on a regular basis on a wide variety of legal issues from Pennsylvania Municipal Authorities Association (PMAA) member Authorities across Pennsylvania in the Firm's role as PMAA's East Region Solicitor.
*  Steve regularly attends municipal authority meetings in a solicitor capacity.
*  Steve provides annual training to municipal authority Board Members on such topics as state ethics requirements, Pennsylvania's Sunshine and Right-to-Know laws and the Municipality Authorities Act.
*  Steve presents Solicitor updates to PMAA member Authorities on case law and legislative developments impacting municipal authorities.

Personal Interests:

While in college, Steve worked as a Weather Forecaster, providing on-air forecasts for numerous radio stations.) He continues forecasting the weather today, and is the official Hamburg, Rubin, Mullin, Maxwell & Lupin meteorologist for all severe weather events.
