Litigation Team Secures Reversal of Tax Sale for Generational Family Property

Attorneys Mark Himsworth and Mark Umansky of the litigation department at Hamburg Rubin Mullin Maxwell & Lupin recently secured a favorable result for a local family by successfully reversing the tax sale of a long-held piece of real estate. The property, which had been in the family for generations, was sold by the county for significantly less than market value after property taxes went unpaid following the death of a family member.

As part of their advocacy, Himsworth and Umansky demonstrated that the county failed to provide proper and legally required notice to the estate regarding the outstanding taxes and the impending sale. The court agreed, ultimately vacating the tax sale and restoring ownership of the property to the family.

“We were proud to help this family reclaim what was rightfully theirs,” said Himsworth, one of the attorneys on the case. “It’s a reminder that due process matters, especially when people’s homes or legacy properties are at stake.”

This outcome highlights the critical importance of proper notice in tax sale proceedings—particularly in cases involving estates or family-owned properties. While the timely payment of property taxes is essential, life events such as the loss of a loved one can cause unexpected disruptions and administrative oversights.

If you or someone you know is facing a potential tax sale, or is involved in the administration of an estate that includes property, it is important to act quickly. These matters are highly time-sensitive, and early legal guidance can be key to protecting ownership rights and preventing unnecessary loss.
